This quicklook summarizes the rules relating to options for granting diplomas to students who entered Grade 9 before the 2011-12 school year and who have satisfied all requirements for graduation other than the passing of exit-level TAAS or TAKS tests (based on flexibility created pursuant to SB 463 passed by the 2017 Texas Legislature and subsequent bills extending the original expiration date for such flexibility – SB 213 passed by the 2019 Texas Legislature and HB 1603 passed by the 2021 Texas Legislature)

 

NOTE: The quicklook described above has been deactivated due to the following:

  • Texas Education Code (Section 28.02541) allows districts to award diplomas to certain students who entered high school before the 2011-12 school year and did not receive a diploma after failing to meet assessment requirements.
  • However, §28.02541 specifically requires TEA to adopt a Commissioner Rule to actually implement the provisions of the law.
  • The Commissioner Rule that was adopted to implement §28.02541 has expired (September 1, 2023).
  • As a result, there is no current rule for districts to follow to award a diploma to a student meeting the eligibility requirements in §28.02541.

This quicklook will be updated and reposted when and if the Commissioner Rule for implementing §28.02541 is revised to be current and effective.

Section 29.081(d) of the Texas Education Code provides that a “student at risk of dropping out of school” includes a student who: did not perform satisfactorily on an assessment instrument administered to the student under Subchapter B, Chapter 39, and who has not in the previous or current school year subsequently performed on that instrument or another appropriate instrument at a level equal to at least 110% of the level of satisfactory performance on that instrument. This chart identifies the scale score that is 110% of the Approaches GL standard (i.e., the “level of satisfactory performance”) for each STAAR assessment. Since it is based on the scale score for Approaches GL, this chart does not change from year to year.
